Rental Housing



Sec. 5-48. Adoption of the International Property Maintenance Code.

  The International Property Maintenance Code, First Edition, 1998, as published by International Code Conference, Inc. ("ICC Code"), as well as all current editions and supplements and future editions and supplements thereto, copies of which are on file with the township code enforcement department, is hereby adopted as the Plymouth Township Property Maintenance Code for the control of rental structures and properties as herein provided; and, each and all of the regulations, provisions, penalties, conditions and terms of said ICC Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this article with the additions, insertions, deletions and changes, if any prescribed in section 5-49 below. Sec. 5-49. Additions, insertions, and changes to ICC Code.

(a)Add the following to Chapter 3 of the ICC Code:



"309.1 No person shall operate for rental a single or multiple-family dwelling, two-family dwelling, or rooming house unless that person holds a current operating license issued by the housing code enforcement official for the specific multiple dwelling, two-family or single-family dwelling or rooming house designated therein.

"309.2 An operating license for rental use for multiple dwelling, two-family dwelling, single-family dwelling or rooming house shall be valid for the calendar year of issuance or the remainder thereof, unless revoked, and such license shall be renewable for successive calendar years. Licenses shall not be transferable.

"309.3 Applications for licenses to operate for rental multiple dwellings, two-family dwellings, single-family dwellings or rooming houses, and for renewal thereof, shall be on forms provided by the housing code enforcement official. Such forms shall set forth the owner's name and address, the number of dwelling units or rooming units, the name of a person, firm or corporation located in the Township responsible for the care and maintenance of the building, and such other information as the housing code enforcement official may require.

"309.4 A license may be revoked for any violation of this ICC Code or for the failure of the owner to maintain a residence, office or agent within the Township.

"309.5 Each applicant for a license to operate a multiple dwelling or two-family dwelling for rental shall, at the time application is made, pay a license fee as established by resolution of Township Council.

"309.6 Each applicant for a license to operate a single-family dwelling for rental shall, at the time application is made, pay a license fee as established by resolution of Township Council.

"309.7 Each applicant for a license to operate a rooming house shall, at the time application is made, pay a license fee established by resolution of Township Council."

(b)The ICC Code is amended and revised in the following respects:

101.1 (page 1, second line) insert "Plymouth Township."

106.4 Amend in its entirety as follows: "Any person violating the provisions of article III shall be guilty of a summary offense and shall be punishable for each offense by a fine as provided in section 1-9 of the Plymouth Township Code."

202 Add the following words and definitions: "Accessory Structure: A building, the use of which is incidental to that of the main building and which is located on the same lot."

Delete the definition for the term "Dwellings: 'Rooming House"' and insert the following definition for the term "Rooming House":

"Rooming house: A dwelling, not a single-family or two-family dwelling, apartment house or hotel, providing lodging with or without meals, and having lodging accommodations for less than ten (10) guests."

302.2 After the words "located thereon" add the following sentence:

"Wherever possible no drainage shall be directed onto adjacent properties."

302.4 After (254mm) add "and all yard areas must be cut and maintained and kept clear of debris."

304.14 (page 10, first and second lines) insert "April 15th thru October 15th."

305.3 Delete this subsection in its entirety and insert the following subsection therefor:

"Interior walls, ceilings, floors and doors: Every interior wall, door and floor or part thereof shall be maintained in sound condition and good repair, free of any holes, cracks, loose plaster, or other defects that would provide access for insects or rodents. All interior surfaces shall be finished with wallpaper, paint or other acceptable material so as to be easily cleanable, reasonably smooth, clean and tight. Floors shall also be reasonably true and level, free of any fixed, irregular or broken surface material that would create a tripping hazard."

602.3 Heat supply. Insert "October 15th to April 15th."

602.4 Insert "October 15th to April 15th."

(c)Add the following subsections:

301.4 Vacant Units Sanitation: No person shall occupy as owner-occupant or let to another for occupancy any vacant dwelling unit unless it is clean, sanitary and for human occupancy. The owner of any structure shall, whenever the same becomes vacant, remove there from all papers or other combustible materials which have accumulated therein or upon any part of the premises. All doors, windows, or other openings into such structure shall be kept closed and locked, or boarded up while the same remains unoccupied.

702.5 Delete the paragraph in its entirety and insert the following subsection therefor:

Means of Egress: There shall be at least two (2) means of egress from each floor above the second floor of every multiple dwelling and rooming house when such units are occupied for living or sleeping purposes, and from a basement used as a dwelling unit or rooming unit when such unit is occupied for living or sleeping purposes. A basement shall not count as a floor for purposes of this section."

(d)The following sections are hereby deleted: Sections 109.6 and 302.8.
